2. VILLA MILENA

1. The description of the Villa and list of amenities are provided in text and photographs on the Villa's website. The Villa Owner is responsible for the accuracy of the information on the Villa's website.

2. Upon the guest's arrival, the Villa must be clean and in full functional condition. The Villa Owner is responsible for the proper functioning of all devices in the Villa. In case of any malfunction, the Villa guest should immediately inform the Villa Owner, who is obliged to resolve the issue as soon as possible.

3. GENERAL RENTAL TERMS

1. Guests are required to act responsibly and with due care in the Villa and its surrounding property, adhering to the rules outlined in these Rental Terms and the House Rules displayed on the Villa's website and in a visible location within the Villa. The price list for services is also displayed in a visible location in the Villa.

2. The Guest agrees to return the Villa in the same condition as received. During the rental period, the Guest agrees to immediately report any damage to the Villa or its property. Upon departure, the Guest must inspect the Villa and its property with the Owner. The Guest is responsible for any damages caused to the Owner. Damages may also include additional cleaning required due to the particularly poor state in which the Villa is returned. In such cases, the Owner is entitled to charge for damages from the security deposit.

3. If the Guest notices insufficient cleanliness, damage, or other deficiencies in the Villa upon check-in, or has other complaints, they must report them. Complaints regarding cleanliness must be made immediately on-site. Other complaints must be reported without delay or no later than 24 hours to the Owner. In such cases, the Guest agrees to provide the Owner with a reasonable period to address the complaint.

4. The Guest must seek approval from the Owner if the total number of people in the Villa or on its property exceeds the allowed capacity.

5. The Owner cannot be held responsible for noise originating from neighboring properties, construction sites, roads, or similar sources. If the Owner can influence the reduction of such noise, they will address it as quickly as possible. Guests must not disturb public peace and order while on the Villa's property.

6. The Owner is responsible for the functionality of the pool equipment, pool cleaning, and water quality. The Owner checks water quality and pool functionality twice a week. Guests are required to follow the Owner's instructions for pool use. Basic pool usage instructions are displayed in a visible location near the pool. Pool use is at the Guest's own risk. Children must not be in or near the pool without adult supervision.

7. Smoking is not permitted inside the Villa. Smoking is allowed outside the Villa. Smokers are requested not to discard cigarette butts in the Villa’s yard.

8. Accommodation prices listed on the Villa's website are expressed in euros.

Reservations begin the rental agreement process.

The Guest must pay a deposit of 30% of the total rental price within ten (10) days of the booking request via bank transfer. If payment is not made within this period, the Rental Agreement is considered terminated, and the Owner may enter into a new Rental Agreement with another guest without prior notice. The Owner may, but is not obligated to, send a reminder to the Guest before terminating the Rental Agreement.

The remaining 70% of the total rental price must be paid via bank transfer no later than thirty (30) days before the rental period begins or in cash on arrival. For bookings made less than 30 days before the rental period, the full amount must be paid immediately. The Owner is not responsible for fees charged by other banks. By paying the reservation deposit, the Guest unconditionally accepts these Rental Terms. Upon receiving the deposit, the Owner will send a written Booking Confirmation via email. The Booking Confirmation includes: the Owner's contact information, the Villa’s address and location, the number of guests, the rental period, check-in and check-out times, the deposit paid, and the total rental price. The written Booking Confirmation and these Rental Terms constitute the Rental Agreement.

If the reservation is canceled up to 60 days before arrival, the deposit will be refunded in full. For cancellations between 20 and 15 days before arrival, 50% of the deposit will be refunded. For cancellations less than 15 days before arrival, the deposit will not be refunded.

Guests are advised to arrange personal cancellation insurance.

9. Upon handover, the Owner will issue the Guest an invoice for the rental. Water, electricity, internet, bed linens, towels, kitchen cloths, final interior cleaning, pool and property maintenance, guest registration, and tourist tax are included in the rental price.

10. The Owner cannot be held liable for "force majeure" events (e.g., war, natural disasters, epidemics, border closures, strikes) that were unforeseeable at the time the Rental Agreement was made.

11. Under EU Regulation No. 2016/679 on personal data protection, all Villa guests must provide a valid personal document (ID card or passport) or consent for the use of necessary personal data for guest registration. The Owner cannot use personal data for other purposes and must destroy such data after registration.

12. Guests have the right to submit a written complaint regarding accommodation services. Complaints should be sent to the Owner’s email address at [email protected]. The Owner is required to respond to complaints in writing within 15 days of receipt.

13. The check-in time for Guests is from 3:00 PM local time. The check-out time is no later than 10:00 AM local time.

14. The Owner will welcome Guests for the handover and registration process. During the handover, the Guest must present a valid personal document for registration. The Guest must pay a deposit of €300. The deposit is held as security for damages to the Owner’s property. The full deposit amount will be refunded upon departure if no damages occur during the Guest’s stay. If damages occur, the Owner may deduct the amount from the deposit. If damages exceed the deposit, the Owner has the right to request the remaining amount in cash on-site.

4. TERMINATION OF THE RENTAL AGREEMENT

The guest of the Villa may terminate the Rental Agreement with the Villa's owner solely in writing via email, without the obligation to provide specific reasons for the termination. The termination of the Rental Agreement takes effect from the date when the Villa's owner confirms receipt of such termination.

5. FINAL PROVISIONS

1. Special requests or inquiries from the Villa guest must be submitted in writing or via email to the Villa owner in advance. If possible, the Villa owner will fulfill the guest's special requests, either personally or through a third party.

2. In case of violation of the provisions of these Rental Terms, the Villa owner is authorized to terminate the Rental Agreement, whereby the guest of the Villa is not entitled to a refund of the paid accommodation fee. The termination of the Rental Agreement takes effect immediately, without a notice period. The guest is obliged to permanently vacate the Villa immediately.

3. Unauthorized use of information published on the Villa's website, even partially, is prohibited by law and constitutes a violation of copyright.

4. The House Rules and these Rental Terms are published on the Villa's website in Croatian, English, German, and Danish. In case of any dispute regarding interpretation, the Croatian version shall prevail.
